"In this hellhole of hatelusters, what's needed is a hatebuster": Rampur Court sentences Samajwadi Party leader Azam Khan to 3-year imprisonment for hate speech against UP CM Yogi Adityanath in 2019 and trying to incite violence between two communities

A special MP/MLA court in Rampur district of Uttar Pradesh today sentenced Samajwadi Party (SP) leader Azam Khan to three years imprisonment in a 2019 case.

Khan has been found guilty in the case lodged over his "provocative remarks" against Uttar Pradesh Chief Minister Yogi Adityanath and the then District Magistrate Aunjaneya Kumar Singh.
Khan is no longer eligible to serve in the state assembly or as a member of Parliament by virtue of the sentence. Before 2013, under Section 8 (4) of the Representation of the People Act, Members of Parliament and MLAs, on conviction for offenses, were allowed a three-month period for filing appeals to the higher court, however, the Supreme Court struck down the provision.
The present case was registered against Khan after the returning officer took cognizance of a complaint made to him by an advocate and a local BJP leader, alleging that Khan was trying to incite violence between two communities by delivering provocative statements.
The complainant had alleged that Khan also used foul language for the then DM and his mother.
Thereafter, the present case was registered against Khan under Sections 153a (promoting enmity between two groups), 505-1 (statement conducing to public mischief) of the Indian Penal Code along with Section 125 of the Representation of People Act 1951.
After the Supreme Court granted interim bail to Khan in May this year in a forgery case, he was released from the Sitapur district jail in Uttar Pradesh. Khan was in jail for over two years and is involved in over 85 cases.
