In a significant ruling on March 13th, a special court in Kota, Rajasthan, delivered justice by sentencing a Muslim cleric, Naseem Khan, to life imprisonment. This verdict came as a result of Khan's heinous act of unnatural sex with a 10-year-old boy within the confines of a mosque. The accused, a 23-year-old native of Palwal district in Haryana, faced the stringent consequences of his actions, underscored by a financial penalty of Rs 21 thousand imposed by the court. This decision was grounded in the serious charges brought against Khan under the Protection of Children from Sexual Offenses (POCSO) Act, marking him as guilty of an egregious crime against a minor.

In an emotional moment after the verdict, the presiding judge offered solace through poetry to the young victim, a gesture that underscored the court's empathy and the gravity of the offense.
The backdrop of this disturbing event was detailed in a complaint lodged at the Budhadeet Police Station by the boy's uncle. It painted a chilling picture of the day the crime occurred, 22nd October of the previous year. According to the complaint, the young victim, a diligent 5th-grade student, had attended the mosque around three in the afternoon for his regular Arabic studies and religious education. It was here, in a setting meant for learning and spiritual growth, that Khan, exploiting his role as a cleric and Arabic tutor, preyed upon the boy. Seizing a moment when the child was alone, Khan lured him into a secluded room where he committed the brutal unnatural sex on him. The horror of the act was compounded by a threat to the boy's life, as Khan warned him of fatal consequences should he disclose the ordeal to anyone, "I will kill you if he tell about this to anyone."

Despite the fear and threat to his life, the brave 10-year-old boy found the strength to return home and reveal the frightening experience he endured at the mosque. His courage to speak up played a crucial role in the subsequent actions taken by the authorities. Upon hearing his story, they quickly acted, arresting Naseem Khan and charging him under the Protection of Children from Sexual Offenses (POCSO) Act.
Additional charges were also applied under various sections of the Indian Penal Code, including 377, which deals with unnatural sexual offenses, and 506, pertaining to criminal intimidation, among others.
The legal proceedings moved with exceptional speed. A chargesheet, a formal document listing the charges against Khan, was prepared and submitted to the court within just fourteen days of the police being informed. This swift action is noteworthy, demonstrating the system's capacity to respond quickly to protect children.
The trial itself was remarkably fast, resulting in a conviction four months and 20 days after the crime was reported. This rapid conclusion of the case is rare and speaks volumes about the commitment to delivering justice for the victim.

Lalit Kumar Sharma, the public prosecutor, played a significant role in this process. He shared with the media how efficiently the police conducted their investigation, completing it in just two weeks. They then presented the chargesheet in court, which was detailed and thorough, comprising twenty-four documents and including the statements of eleven witnesses. This diligent work by the police and prosecution ensured that all necessary evidence was gathered and presented effectively, leading to the swift conviction of Khan.
This case underscores the importance of speaking out against wrongdoing and the effectiveness of the legal system when it acts promptly and decisively. The young boy's ordeal, though harrowing, led to the swift arrest and conviction of the perpetrator, highlighting the power of courage and the importance of a responsive justice system in protecting the innocent.
Justice Prevails: Cleric Faces Life Imprisonment Despite Plea of Innocence
In the final stages of the trial, the cleric's defense attorney argued that his client was not guilty. However, the evidence and arguments presented by the prosecution were convincing enough for the court. The prosecution had even asked for the death penalty because of the seriousness of the crime.
Ultimately, Judge Deepak Dubey of Posco Court No. 3 in the Kota district decided the cleric's fate. The man was adjudged culpable of sodomy and handed down the punishment by the court under the Protection of Children from Sexual Offenses (POCSO) Act.
He ruled that Naseem Khan must spend the rest of his life in jail and also pay a fine of twenty-one thousand rupees.
As he was taken to prison following the verdict, the cleric made a point of hiding his face, a gesture that did little to conceal the gravity of his actions or the outcome of the trial.
In a touching and unusual move, Judge Deepak Dubey chose to address the young victim with a poem, highlighting the court's empathy and concern for the child's emotional healing. The poem expressed a message of purity, innocence, and hope, encouraging the child to move past this traumatic experience. "My little innocent angels. You are pure and innocent. The world revolves around your smile. The Light of Allah resides in your face. Erase the bitter memories from your mind. We have sent your culprit behind bars for life. Now live this life with laughter. The tears of your eyes will not come home with you."
This verse not only served as a condemnation of the heinous acts committed but also as a beacon of hope and reassurance to the victim. The judge's words were a powerful reminder that justice had been served and that it was time for healing to begin.
